Welcome to MaintenancePay ("Platform", "we", "us", "our"), a product of Ivan Digital Solutions. These Terms and Conditions ("Terms") govern your access to and use of the MaintenancePay website (maintenancepay.com), mobile applications, and related services (collectively, the "Services").
By creating an account, accessing, or using our Services, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree, please do not use our Services.
You must be at least 18 years of age and an authorised representative of a registered housing society in India to create a Committee Administrator account. You agree to provide accurate, current, and complete information during registration and keep your credentials confidential. You are solely responsible for all activities conducted through your account.
MaintenancePay provides the following services:
All maintenance payments collected from Residents are processed through our integrated Payment Gateways. Settlements are deposited directly into the Society's registered bank account, typically within T+1 to T+3 business days as per Payment Gateway terms. MaintenancePay does not hold, pool, or manage Society funds at any point. Payment Gateway transaction fees (typically 1.5–2%) are charged separately by the Payment Gateway provider and are not set by MaintenancePay.
MaintenancePay offers tiered subscription plans billed per flat, per month. All plans include a 30-day free trial with no credit card requirement. Pricing details are available at maintenancepay.com/pricing. We reserve the right to modify pricing with 30 days' prior written notice. All prices are exclusive of applicable GST (18%).
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, access continues until the end of the current billing cycle. Subscription fees already billed are non-refundable. For resident payment refunds, please refer to our Refund & Cancellation Policy.
As a User of MaintenancePay, you agree to:
All content, trademarks, logos (including the mPay logo), software, design, and technology on the Platform are the exclusive property of Ivan Digital Solutions. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for its intended purpose during your active subscription. You may not reproduce, modify, distribute, or create derivative works from any part of the Platform.
We collect and process personal data in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDP Act). By using the Platform, you consent to the data practices described therein. Residents may request deletion of their personal data by visiting our Data Deletion page.
To the maximum extent permitted by applicable Indian law:
You agree to indemnify, defend, and hold harmless Ivan Digital Solutions, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including natural disasters, pandemics, government orders, internet outages, cyberattacks, or Payment Gateway system failures.
We may update these Terms from time to time. Material changes will be communicated via email to registered Committee Administrators at least 15 days before they take effect. Continued use of the Platform after changes constitute acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India. Before initiating legal proceedings, both parties agree to attempt resolution through mediation.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
